Instructions for Requesting Permission to Use Copyright Materials

Any use of materials contained within the Blackerby Associates, Inc. domain on the World Wide Web (www.BlackerbyAssoc.com) without the prior express written consent of Blackerby Associates, Inc. is strictly prohibited in accordance with U.S. copyright law and international treaties.

Prior written consent is sometimes given, in certain circumstances and under certain conditions. Please write to Blackerby Associates, Inc. to request permission. In your request, please provide:

  • Your name, title, organization, complete location address, telephone and fax numbers and e-mail address.
  • The name, title, telephone number and e-mail address of the official responsible for ensuring that the circumstances and conditions are met.
  • A description of the specific materials you wish to use. Cite document title or file name, and file names of graphics (file names are found in the Address block of your browser).
  • The purpose for the requested use (for example, "To publish in our quarterly Company News newsletter.").
  • The proposed distribution of the copyright materials, including number of copies, types of recipients, and cost of publication (for example, "Distributed free to the 1,200 employees of the Three Initial Corp.").

Before you request, please read the standard Copyright Permission Agreement that follows. By requesting permission to use copyright materials, you are also agreeing to all the provisions contained in the Copyright Permission Agreement. Please make sure you meet all of these conditions before you submit your request!


Copyright Permission Agreement

  1. This agreement is between Blackerby Associates, Inc. and _________________________ (Requestor).
  2. Blackerby Associates hereby grants limited permission to Requestor to use the following copyright material(s):

  3. Permitted use is limited to one use in a single publication. You may request additional uses, if necessary, in writing.
  4. This limited permission is not transferrable to another person, organization, entity, or publication, for any reason. Any use other than the use permitted in this Agreement is strictly prohibited.
  5. Any use must be accompanied by credit citation, substantively similar to:
  6. "© Copyright 20__, Blackerby Associates, Inc., Phoenix, Arizona, USA, www.BlackerbyAssoc.com. Used with permission."
  7. The permitted user will take all reasonable precautions to protect the Blackerby Associates, Inc. copyright, and to prevent the unauthorized use of copyright materials.
  8. Any publication using Blackerby Associates, Inc. copyright materials must be distributed free of charge. Any gross revenue from the sale or distribution of Blackerby Associates, Inc. copyright materials is the property of, and must be turned over to, Blackerby Associates, Inc.
  9. Please send us a copy of any publication using our materials (we would also like to be added to your mailing list, if possible!).
  10. The permitted user acknowledges:
    1. That the copyright material is the property of Blackerby Associates, Inc., and that the Blackerby Associates, Inc. copyright is protected under United States laws and international treaties.
    2. That Blackerby Associates, Inc. makes no representation or warranty, expressed or implied, with respect to the sufficiency, accuracy or utility of any information or opinion contained within the Blackerby Associates domain on the World Wide Web (www.BlackerbyAssoc.com).
    3. That Blackerby Associates specifically disclaims all warranties, express, implied or otherwise, including without limitation, all warranties of merchantability and fitness for a particular purpose.
    4. That Blackerby Associates expressly advises that any use of or reliance upon said information or opinion is at the risk of the user, and that Blackerby Associates shall not be liable for any damage or injury incurred by any person arising out of the sufficiency, accuracy, or utility of any information or opinion contained therein.
    5. That nothing contained herein shall be construed as conferring by implication, estoppel or otherwise any license or right under any patent or trademark of Blackerby Associates or any third party.
    6. That, except as expressly provided above, nothing contained herein shall be construed as conferring any license or right under any Blackerby Associates copyright.

  11. This limited permission expires six months after the date it is granted. It may be renewed by another written request.
